I. GENERAL INFORMATION
1. The internet shop vipdelikatesy.pl (hereinafter called ‘the Shop’), operating at the web address www.vipdelikatesy.pl, is the company Vipdelikatesy.pl headquartered at 00-866 Warsaw, ul. Żelazna 58/62 m.1517, tel: (022) 654 43 76, mob. 694 422 627, email: biuro@vipdelikatesy.pl, REGON 014164279, NIP 5272193665.
2. The processing of orders by the Shop follows the rules laid out in these Regulations.
3. In order to use the Shop’s services, the Client must have access to the Internet, an email account, and a mobile telephone number. In order for the service to function correctly, the user’s computer must have cookies enabled.
4. Product prices are gross prices including VAT and are in PLN.
II. ORDERS
1. Orders are placed online directly on the www.vipdelikatesy.pl webpage by using the mechanism provided there.
2. The placing of an Order and purchasing the Products requires the Purchaser to correctly complete the registration form and familiarise himself with and accept the Shop’s Regulations.
3. The registration process is completed once, and future orders are placed by the Purchaser logging into the Shop’s service and entering the password.
4. The placement of the Client’s order will be confirmed by email. In certain justified cases the order may be processed after verification of the Client’s order by telephone.
5. The placing of the order by the Client constitutes an Offer as laid out in civil law. The sending of the Shop’s email confirming the placement of the order by the Client constitutes an acceptance of the Offer within a realistic scope. The presence of products on the Shop’s webpage does not guarantee their availability in the warehouse and the processing of the order.
6. The Shop reserves the right to refuse to process orders: a. placed by incorrect completion of the form, b. following an unsuccessful attempt to confirm the order,
7. It is possible to place Orders with the Shop 24 hours per day, every day of the year.
8. The Shop does not process orders on public holidays. The Shop reserves the right to select days when orders are not processed other than those defined above after informing the users of the fact on the Shop’s webpage in advance, at least 7 days.
9. A VAT receipt listing all ordered items is provided with the order at time of delivery. The Purchaser authorises the Shop to issue VAT receipts without the receiver’s signature.
10. In the event that a Product is not being in stock or temporarily unavailable, the Shop will execute the order without the missing items informing the client about that.
III. PAYMENTS
1. Payment options include: - bank transfer to account no. 65 1440 1299 0000 0000 0187 8859 - payment or credit card via the online payment system on the Shop's webpage. Online payment with a payment card is only possible if the Purchaser’s card allows this function.
2. The Shop does not send deliveries COD.
3. The Purchaser makes payment after receiving an email confirming the order from the Shop.
4. The Shop will begin processing the order after: - confirming that the full amount has cleared into its bank account, including transport charges (in the event of a bank transfer), or - the transaction has been authorised by the operator responsible for clearing online card payments (in the event of payment with a payment or credit card).
5. Product prices published on the Shop’s webpage do not include transport charges.
6. When making payment for the placed order it is necessary to provide the order number included in the Shop’s confirmation email.
7. The Shop sells products with a variable weight (e.g. meat, fish, seafood). Prices provided for those products on the Shop’s webpage are guide prices only. The product’s final cost depends on its actual weight. The product’s weight and its final price are shown on the VAT receipt. In the event of a situation where the cost of products with variable weight was lower at the time of the Client placing the order than the final price shown on the VAT receipt, the Client authorises the Shop to accordingly adjust the cost (resulting from the variable weight of the products) and is obliged to pay the difference in cash at the point of delivery. The Client can check his account balance at any time on the “My account” tab.
8. Any excess payment made by the Purchaser for Products that are not in stock or are temporarily unavailable will be repaid by the Shop via an online transfer to the Purchaser's bank account or returned to his credit card.
IV. DELIVERY
1. Ordered goods are delivered by KM TRANS, a company specialising in temperature-controlled transport of goods, or another courier company able to ensure the required transport conditions (temperature control of transported goods). For bulk orders and orders and deliveries of fresh articles it is also possible to arrange an alternative method of transport, after agreeing costs and delivery dates with the Purchaser.
2. The Supplier leaves the order with whoever is present at the address provided by the Purchaser.
3. Deliveries are made in Warsaw and within a 25 km radius from the centre. It is also possible to arrange deliveries to other parts of Poland after a prior arrangement with the Shop.
4. The Shop charges a fixed fee of 25 PLN gross for deliveries within Warsaw and its surroundings. Delivery costs will be agreed on an individual basis in the event of a delivery outside of Warsaw and surroundings.
5. Deliveries are made every Tuesday and Friday between 07.00-22.00, with the exception of public holidays when orders are not processed.
6. For Tuesday deliveries, the Shop processes the orders for which it is able to confirm payment has been made by the Purchaser, according to Section III pt. 4 of these Regulations, at the latest by 12.00 noon on the preceding Monday. For Friday deliveries, the Shop processes the orders for which it is able to confirm payment has been made by the Purchaser, according to Section III pt. 4 of these Regulations, at the latest by 12.00 noon on the preceding Thursday.
7. At the point of delivery, the Purchaser in his own interest should check, in the presence of the deliverer, whether the order has sustained any damage during transport, whether it is intact and in accordance with the order, and confirm the receipt of the order.
8. In the event of the Client’s absence at the delivery address and specified delivery time an attempt will be made to contact the Client by phone in order to agree an alternative delivery conditions. The Client will be charged with transport costs for each delivery attempt.
V. COMPLAINTS AND RETURNS
1. According to art. 10 of the Act of 2 March 2000 regarding the protection of certain consumer rights and the liability for damage caused by dangerous goods, the Purchaser has the right to withdraw from the agreement within 10 days of the delivery of the Products, save as point 2 below. Returned goods must be complete, and must not bear signs of use.
2. In the event of withdrawing from the agreement and returning of the goods , the Purchaser will receive a refund for the returned goods, and is obliged to return the goods in their original condition. The return must be made promptly and no later than within 14 days of the Shop receiving notice of withdrawal from the agreement.
3. At the point of delivery, in the event of discrepancy between the delivered good and the placed order, the Client must inform the deliverer of the fact and decline to receive any products he did not order.
4. In the event of any complaint, the Purchaser must contact the Shop by email or telephone.
VI. FINAL STATEMENTS
1. All personal data are subject to protection according to the Data Protection Act of 29 August 1997 (Journal of Laws 1997 No. 133, item 883). By placing the order, the Purchaser consents to data processing by the Shop. The Purchaser also consents to data processing by the Shop by subscribing to receive information from the Shop electronically (‘newsletter’).
2. The Shop makes every effort to update the images of presented products.
3. Matters not covered by these Regulations are subject to civil law regulations and the act regarding the protection of certain consumer rights and the liability for damage caused by dangerous products from 31 March 2000 (Journal of Laws No. 22, item 271 as amended).
